Overview

What is Sexual Harassment?

To put it plainly, sexual harassment is violating a person by unwanted sexual advances. In the workplace, the most prevalent type of sexual harassment is what’s called the “quid pro quo” (this for that). It means getting something in return for sexual favors such as, but not limited to, firing an employee if they don’t agree to sleep with the person of authority or date them.

What is workplace violence?

Workplace violence is a threat of or actual violence against workers. It can happen inside or outside work premises and can vary from verbal abuse and threats to physical assaults and homicide.

Sexual harassment can have devastating effects for the people involved — especially for your company — if not dealt with properly at all levels. Employee harassment places the security and safety of all involved at risk, and it can endanger and jeopardize the well-being of your whole organization.

California Training

California remains at the lead of workplace harassment law. Senate Bill 1343 requires employers with five or more workers to provide sexual harassment training to all employees by January 1, 2021, and then every two years.

For employers with five or more employees, the law requires that:

  • Supervisors must complete at least two hours of offline or online instruction and education on sexual harassment prevention.
  • New supervisors must be trained within six months of becoming a supervisor.
  • Nonsupervisory workers must complete at least one hour of offline or online instruction and education and new nonsupervisory employees must receive training in six months.
  • Temporary, Project-based, and seasonal employees – or can pertain to any employee hired to work for less than 6 months – must also be trained within 30 calendar days after their hire date or within 100 work hours, whichever comes first.
  • Employees and supervisors who were trained in 2019 must be retrained in two years.
  • Company owners must keep records of the training for at least two years.

Connecticut Training

This program meets Connecticut’s content requirements for employee- and manager-specific sexual harassment and workplace violence prevention training.

Connecticut’s law, known as the Time’s Up Act, had been in effect since October 1, 2019. 

This applies to all employers, regardless of the size of their company.

Under the new law:

  • All employers in Connecticut must train supervisors on sexual harassment prevention by October 1, 2020, or within six months of an employee hired or promoted to a supervisory role.
  • Companies with three or more employees must provide two hours of training to all employees, not just supervisors.
  • Existing employees must be trained by October 1, 2020, and then retrain every 10 years.

Businesses with 50 employees and above are required to provide interactive instruction and education to all employees (including seasonal and temporary employees) by January 1, 2020.

Also, for covered employers, the law requires that:

  • All new employees and supervisors must be trained within the first year of hire, and then every two years.
  • Supervisors must receive additional training on their duties to prevent and correct sexual harassment and retaliation, and undergo retraining every two years.
  • All employers, regardless of the number of workers, must distribute the Department of Labor’s Sexual Harassment Notice to each new employee.

The Workplace Transparency Act goes into effect on January 1, 2020. Under the new law:

  • All Illinois employers, regardless of the size of the company, must conduct a yearly sexual harassment training to all employees.
  • Restaurants and bars must have sexual harassment prevention training and policies aligned with the restaurant and bar industry.
  • Training must meet or exceed the standards of the training model of the Illinois Department of Human Rights.

Maine requires employers with 15 or more employees to provide training to all employees within one year of hire. Also, for covered employees, the law requires that:

  • Supervisory and managerial employees must undergo further training on their specific duties to address sexual harassment complaints within the first year of their hire or promotion.
  • Businesses must keep training records for at least three years and must make the records available for inspection upon request.

New York Training

Since October 2019, all New York employers must now provide annual sexual harassment training to all employees and supervisors − including part-time, seasonal and temporary workers, regardless of their immigration status. Another significant change this year is that employees are no longer required to prove that alleged sexual harassment was “severe or pervasive” to hold perpetrators and employers accountable.

New York requires that:

  • Newly hired workers are trained as soon as possible after their start date.
  • All workers must undergo training, regardless of immigration status, including part-time, temporary, and seasonal workers.
  • Training must be interactive, requiring some level of employee participation and maybe done online.

Employers should provide training in the language spoken by their workers.
Business owners are encouraged (but not required) to save a copy of training records and a signed acknowledgment that workers have read the organization’s sexual harassment prevention policy.
